With the start of every new year comes a slew of new laws that come into effect. Here are four that are the most impactful and significant within New York.
Minimum wage will increase in 2026, from $16.50 to $17 an hour in New York City, Long Island, and Westchester, and from $15.50 to $16 for other places in the state. Future increases will begin in 2027, annually increasing based on inflation. This comes amid widespread attention to New York’s affordability crisis, particularly in the recent mayoral election for the city.
This year will also bring a substantial increase to the Empire State child credit for many taxpayers. The state will offer tax credits for families with children under 4, totaling up to $1,000 per toddler depending on families’ income. The law also gives families with children between 4-17 years old a smaller credit, $330 per child, which will rise to $500 next year. These payments aim to reduce child poverty while providing financial relief to low-income families struggling with the state’s high cost of living.
For those who pass away suddenly, some may not have decided whether to designate themselves as organ donors for the thousands of people in need of transplants. The list of people allowed to make the choice was previously limited to immediate family members or designated health care agents. A close friend will now be allowed to authorize organ donation on the deceased’s behalf, as is the law in 43 other states as well as Washington D.C.
New York City will also expand the Earned Safe and Sick Time Act (ESSTA), starting February 22nd. The scope of qualifying reasons for paid safe and sick time off will be broadened. Employers will also be required to grant 32 hours of unpaid leave to employees, either upon hire or the beginning of each benefit year.
